Mediation vs. Divorce Litigation: Which is right for you?

Mediation is an alternative and cost effective  method to resolving most family law issues; with the exception of matters  pertaining to domestic violence.   The mediator acts a a neutral party who assists the parties involved in the family law dispute resolve their conflict.  The mediator guides the parties to assist them to reach their own resolution, but the mediator does not make decisions for the parties or advocate for either party.

Successful mediation usually requires:

  • both parties be willing to mediate the dispute
  • both parties have an understanding of their own finances, assets, and the nature of the dispute or disputes
  • there must be no active restraining order or domestic violence issues
